▸研討會簡介:

我國設立智慧財產法院迄今已十年,受理案件總數逾一萬三千件,同時涵蓋各類智慧財產爭議民刑事及行政案件,法院判決見解不僅深深影響經濟部智慧財產局之審理標準,亦攸關產業界之智慧財產佈局思維,對我國智慧財產法律之演進產生關鍵影響。

國內已有相當豐富文獻,從實體面分析智慧財產法院判決,並提出興革建議,不過從訴訟程序面檢視法院運作所面臨的問題,並不多見。例如,在專利、著作權或營業秘密的侵權訴訟,如何取得證明被告侵權行為之證據,往往是訴訟之勝敗關鍵,在美國的此類訴訟,原告得藉由discovery取得被告公司的軟體程式碼、晶片電路設計圖、被控侵權物的內部設計規範及規格等相關機密資料,並於取得文件、分析內容後,再據此詢問被告公司員工,無數書證、物證及人證的累積,當較易釐清真相,追懲不法。

本次研討會將專注研究如何從程序面解決問題,如果我國法規在程序面的支撐不足,短期內亦不可能採取discovery制度,則我國如何藉由修改法規實體面,以解決程序面不足的問題。為期以最有效率的方式瞭解各國解決類似問題的方法,我們邀請美、德、日、中、韓各國最頂尖的一線執業律師,來臺分享經驗,同時廣邀我國法官、律師對談,期立於幫助法院的立場,百尺竿頭,更進一步。

▸Conference Introduction:

Taiwan’s Intellectual Property Court has been established for 10 years, and has handled more than 13,000 various intellectual property disputes, including civil, criminal and administrative matters. Judgments of the Intellectual Property Court have not only deeply affected the law enforcement standards of the Intellectual Property Office of Ministry of Economy Affairs, but have also greatly influenced the direction of intellectual property strategy. The IP Court judgments have undoubtedly played a critical role in the evolution of intellectual property law in Taiwan.

Numerous documents have analyzed judgments of the IP Court from substantive aspects and proposed suggestions for the Court’s development. However, problems relating to litigation in the IP Court have received less attention. For example, obtaining evidence of infringement is often the key to successful litigation outcome in patent, copyright and trade secret infringement litigation. For such litigation cases in the USA, the plaintiff can obtain the defendant company’s confidential information, such as software codes, circuit designs of a chip, internal design specifications and specifications of the infringed objects through the discovery system. After obtaining and analyzing such information, the staff of the defendant company will be questioned accordingly. It is easier to clarify the truth and punish illegal conduct when there is substantial documented evidence, material evidence and human testimony.

This conference focuses on problem solving from the procedural level. Due to the lack of support in the procedural aspects of Taiwan’s laws and regulations, a discovery system cannot be adopted in the short term. It is our hope to solve the deficiencies of procedures by amending current laws and regulations. In order to seek the most effective way forward by considering solutions to similar problems in other countries, we have invited the best and the most experienced lawyers from the USA, Germany, Japan, China and Korea to share their experiences. We have also invited the IP Court judges to join the conversation with the lawyers in order to help the IP Court make further progress.
